Rules vary from casino to casino. In some if your cards are face down over the line they're mucked. Obviously i'd rule according to whatever the casino rule is on that matter. People need to learn to table their cards.

The problem is not always the floor.
What happens when you psuedo-fold and the dealer, thinking you are conceding the pot, mucks hands starting with the closest too him (the other person's hand) and intends to award him the pot. Then you say oh wait I am actually still live lets play it out. Now the dealer fucked up but it was clearly your action that caused the dealer to fuck up at the other player's expense. A floor ruling that your hand is live and the other player's hand is irretrievable thus you win is pretty bad.

this actually happened?
okay if you get a rookie dealer who's had no training and doesn't know what poker is, i agree that on occasion a bizarre scenario may arise. however, it is the players responsibility to protect their cards. if your hand gets killed because of a dealer error, or an angry idiot throwing his cards across the table, tough shit. cap your cards and don't let the dealer touch a winner until he pushes you the pot.
same argument applies, if the floor doesn't know the rulebook, play somewhere else. if the dealer doesn't know the rulebook, play somewhere else. if the game is so bad that dealer/floor errors are more than compensated by additional soft action, don't bitch about the shit staff.

I guess you don't play in too many shitty casinos. dealers are paid via tips and get more money the more hands they can deal, thus they tend to rush things along.

The only thing i have to add here was that in a big live tournament:
UTG raised, UTG+1 (shorty) shoved, I cold called in MP with tens and UTG called as well.
Board ran K65T, I bet turn, UTG folded.
Utg + 1 mucked and walked away, dealer opened the cards and dealt the river (UTG+1 actually drawing death in this case)
So I'm guessing in a real tournament you would not get into this situation because in all situations your cards are always turned face up.
