Bwin Wins German Court Case

Law, 2007-05-25, by TwoGun

Bwin, operators of Poker Room, recently won a significant court case in Germany. The German state of Bavaria had attempted to prevent the online gambling company from taking bets from its residents. Recently, the Bavarian administrative court ruled in favor of Bwin, finding that it is technically impossible for the company to exclude just the residents of Bavaria.

Bwin has certainly had its share of legal controversy in Europe. In the fall of 2006, its CEOs were arrested in France due to the company's marketing towards French players. That case is still unresolved.

It is not clear if this case will set a significant precedent. The case seems to imply that, to ban online gambling in Germany, it would need to be done so at a national level instead of a state level.
